1. Agreement to Terms By accessing mywebsimple.com or engaging any services provided by MyWebSimple ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

2. Services Provided MyWebSimple provides professional digital and business services to small businesses, including but not limited to: website design, development and maintenance, e-commerce storefront setup, graphic design, search engine optimization, content creation, social media advertising, inventory and operations management, small business planning and formation, taxation and compliance assistance, customer management, policies and document drafting, reputation growth, and data analytics. Service scope, deliverables, and timelines are defined in individual project agreements or proposals.

3. Client Responsibilities You agree to:

  • Provide accurate, complete, and timely information necessary for service delivery
  • Review and approve deliverables within agreed timeframes
  • Maintain ownership of and rights to any content, materials, or assets you provide to us
  • Comply with all applicable laws in connection with your use of our services
  • Not use our services for any unlawful, fraudulent, or harmful purpose

4. Payment Terms

  • All fees are outlined in your project proposal or service agreement
  • Payment is due per the schedule specified in your agreement
  • Late payments may result in suspension of services until the outstanding balance is resolved
  • All sales are final unless otherwise specified in writing; refunds are handled on a case-by-case basis at our discretion

5. Intellectual Property Upon receipt of full payment, you will own the final deliverables produced specifically for your project. MyWebSimple retains the right to display completed work in our portfolio unless you request otherwise in writing. We retain ownership of all proprietary tools, templates, frameworks, and methodologies used in delivering services.

6. Third-Party Platforms Many of our services involve third-party platforms including Shopify, WooCommerce, BigCommerce, Wix, GoDaddy, and others. Your use of these platforms is subject to their respective terms of service. MyWebSimple is not responsible for changes, outages, policy updates, or limitations imposed by any third-party platform.

7. Confidentiality Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. This obligation survives the termination of any service agreement.

8. Disclaimer of Warranties Our services are provided "as is" and "as available." While we strive for excellence in every engagement, MyWebSimple makes no guarantees regarding specific business outcomes, search engine rankings, advertising performance, revenue results, or any other performance metrics. Results vary based on factors outside our control.

9. Limitation of Liability To the fullest extent permitted by law, MyWebSimple shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.

10. Termination Either party may terminate a service engagement with written notice per the terms of the applicable service agreement. Upon termination, you are responsible for payment of all work completed through the termination date. MyWebSimple reserves the right to terminate services immediately for non-payment or violation of these terms.

11. Governing Law These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Houston, Texas.

12. Changes to These Terms We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or services following any changes constitutes your acceptance of the revised terms.
